1.About these terms
These Terms of Service govern your use of intraafricatours.com and any safari, birding expedition or tailor-made itinerary arranged by Intra Africa Tours, including trips marketed under our birding sub-brand, Birding Around-Africa.
By sending an enquiry, confirming a booking or paying a deposit you accept these terms on behalf of yourself and everyone travelling in your party.
2.Who we are
Intra Africa Tours is an East African tour operator founded and led by John Gitiri, based in Nairobi, Kenya · East Africa. We can be reached at info@intraafricatours.com or on WhatsApp at +254 711 743 727. References to "we", "us" and "our" mean Intra Africa Tours; "you" means the person making the booking or using this website.
3.Definitions
- Itinerary — the written day-by-day plan for your trip, as confirmed in writing by us.
- Designed itinerary — a published trip on this website that you can book as it stands.
- Tailor-made safari — a trip built to your requirements after a planning conversation.
- Third-party supplier — a lodge, camp, airline, park authority, transport provider or activity operator whose services form part of your trip.
- Lead traveller — the person who makes the booking and is responsible for payments and communication.
4.Use of this website
You may browse this website, download pages for personal trip planning and share links to it. You may not scrape it at scale, attempt to access non-public areas, interfere with its operation, or use it to transmit unlawful or harmful content.
The administration area of this site is restricted to authorised staff. Attempting to access it without authorisation is prohibited.
5.Enquiries and quotations
An enquiry is not a booking. When you submit an enquiry or custom safari request we reply with availability and a quotation, normally within one working day (eat, gmt+3).
Quotations are valid for 14 days unless we state otherwise, and are based on the party size, travel dates, accommodation standard and park fees applicable at the time of quoting.
6.Booking and confirmation
A booking exists only when we have issued a written confirmation and received your deposit. The lead traveller must be at least 18 years old and must provide accurate names as they appear on passports.
We may decline a booking where a trip is full, where the itinerary is unsuitable for the party, or where required supplier space cannot be secured.
7.Prices and what they include
Prices shown as "from" figures indicate the lowest per-person rate for the stated party size and season. Your quotation states exactly what is included.
Unless stated otherwise, prices exclude international flights, visas, travel insurance, tips, drinks, laundry, optional activities and items of a personal nature.
8.Payment terms
- A deposit, stated in your confirmation and normally 30% of the trip cost, is payable to secure the booking.
- The balance is due 45 days before departure, or immediately for bookings made inside that window.
- Some lodges, camps and permit types require full non-refundable prepayment; we will tell you in writing before you commit.
- Bank charges and card processing fees are payable by you.
9.Price adjustments
Once your booking is confirmed we will not change the price except where costs outside our control change — most commonly government park and conservancy fees, permit prices, or fuel and exchange-rate movements of more than 5%. We will explain any adjustment in writing and you may cancel without penalty if it exceeds 8% of the trip cost.
10.Changes requested by you
We will try to accommodate changes to dates, party size or accommodation. Changes are subject to availability and to any charges levied by suppliers. Reducing the party size may increase the per-person price because vehicle and guiding costs are shared.
11.Changes made by us
Safari itineraries are operated in wild country. We may substitute accommodation of a comparable or better standard, adjust the order of days, or change routes and game-drive plans where weather, road conditions, park closures, wildlife movement or safety require it. We will tell you as soon as practical and keep the character and quality of the trip intact.
12.Cancellation by you
Cancellations must be sent to us in writing. The following charges apply:
- More than 60 days before departure: loss of deposit.
- 60 to 31 days before departure: 50% of the trip cost.
- 30 to 15 days before departure: 75% of the trip cost.
- 14 days or fewer, or no-show: 100% of the trip cost.
Non-refundable supplier payments — notably gorilla and chimpanzee permits and peak-season camps — are charged in full at any time after they have been issued.
13.Cancellation by us
We may cancel a trip if the minimum party size is not reached, if payment is not received by the due date, or if circumstances beyond our control make operation unsafe or impossible. If we cancel for a reason other than your non-payment we will offer alternative dates, an equivalent trip, or a refund of monies we hold and can recover from suppliers.
14.Unused services
No refund is due for accommodation, drives, activities, meals or transfers that you choose not to use, or that you miss through late arrival, illness or your own actions.
15.Passports, visas and health requirements
You are responsible for holding a valid passport, the correct visas or East Africa Tourist Visa, and any vaccination certificates required by Kenya, Uganda or Tanzania. We are happy to advise, but we cannot be liable for refused entry or for costs arising from incorrect documentation.
16.Travel insurance
Comprehensive travel insurance is a condition of travelling with us. Your policy must cover medical treatment, emergency evacuation by air, repatriation, cancellation and curtailment, and your personal equipment including optics and camera gear. We may ask for your policy details before departure.
17.Fitness, health and suitability
Some trips involve long drives on rough roads, early starts, walking at altitude, forest tracking or remote camping. You must tell us at the time of booking about medical conditions, mobility limits, allergies and dietary needs so we can confirm the itinerary is suitable or adapt it.
18.Children and family travel
Children are welcome on most itineraries, and we will advise where minimum-age rules apply — gorilla and chimpanzee trekking and some walking activities have legal age limits. Children under 18 must travel with a parent or guardian who is responsible for their conduct and safety.
19.Conduct, safety and wildlife rules
Your guide's instructions are final on all matters of safety. You must remain in the vehicle unless told otherwise, keep a lawful distance from animals, respect park regulations, and never feed, bait or call wildlife.
We may end a trip without refund where a traveller's behaviour endangers others, wildlife or staff, or where it is illegal or persistently disruptive.
20.Wildlife and birding expectations
Wildlife is wild. We plan itineraries, timings and locations to maximise your chances, and our guides are trained naturalists, but we cannot guarantee any particular species, migration event, nest, or sighting. Trip lists and reports on this website describe past experience, not a promised outcome.
21.Third-party suppliers
Where we arrange lodges, camps, flights, permits and activities we do so as your agent and those services are subject to the supplier's own terms and liability limits. We select suppliers carefully but are not responsible for their independent acts or omissions.
22.Circumstances beyond our control
We are not liable for failure to perform where it is caused by events outside our reasonable control, including extreme weather, flooding, fire, drought, epidemic or public-health restrictions, civil unrest, strikes, government action, park closures, airspace closures or the failure of public utilities.
23.Our liability
We accept responsibility for the reasonable care and skill of our own guiding, planning and ground arrangements. Our total liability for any claim is limited to the amount you paid us for the trip.
We are not liable for indirect or consequential loss, including missed connections, missed events, lost earnings or lost enjoyment beyond that limit. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence.
24.Complaints and dispute resolution
If something is wrong during your trip, tell your guide immediately so we can put it right on the ground. If a matter remains unresolved, write to info@intraafricatours.com within 28 days of returning and we will respond within 14 days. We will attempt good-faith resolution before any formal proceedings.
25.Photography and image rights
Photographs and text on this website are owned by Intra Africa Tours or used with permission, and may not be reproduced commercially without written consent. We may occasionally photograph groups in the field; tell your guide if you prefer not to appear in material we publish and we will respect that.
26.Intellectual property
The Intra Africa Tours and Birding Around-Africa names, logos, itinerary text, expedition reports and site design are our intellectual property. You may quote short extracts with attribution and a link; wholesale copying or republication of itineraries is not permitted.
27.Privacy and data protection
Personal information you give us is handled in line with our Privacy Policy and with Kenya's Data Protection Act (2019) and the EU General Data Protection Regulation where it applies. See the Privacy Policy for retention periods and your rights.
28.Responsible travel and conservation
We operate low-impact trips, support community conservancies and contribute records from our birding work to Kenyan monitoring projects. We ask guests to travel accordingly: no off-track driving, no single-use plastic where avoidable, no purchase of wildlife products, and photography that never disturbs a subject.
29.Severability and entire agreement
Your written confirmation, the itinerary and these terms form the whole agreement between us. If any provision is found unenforceable, the remainder continues in force.
30.Governing law and jurisdiction
These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute arising from them or from a trip we operate.
31.Changes to these terms
We may update these terms to reflect changes in law, supplier practice or how we operate. The version published on the date you confirm your booking is the version that applies to your trip.
